Linde: US Supreme Court confirms patent win

(CercleFinance.com) - The US Supreme Court has declined to review an appeals court decision affirming Praxair's right to sell a generic form of inhaled nitric oxide, parent company Linde said on Wednesday.


This decision ends a long-running patent dispute with drugmaker Mallinckrodt, and affirms the ability of Praxair - a wholly owned subsidiary of Linde - to continue supplying inhaled nitric oxide, the industrial-gas giant said.

The announcement comes as doctors investigate the use of nitric oxide, a nonflammable and colorless gas, to treat COVID-19 patients with mild to moderate disease, and thereby avoiding the need for ventilation.
