Iliad: favourable ruling from Court of Cassation
(CercleFinance.com) - Free announces that it will be able to address an additional market of 17 million subscribers in mobile packages including the subsidising of terminals, after a ruling by the Court of Cassation challenging the system of subsidising mobile terminals.
The Iliad subsidiary reports that the Court ruled in its favour, considering the subsidising of terminals as part of a mobile telephone contract is, in reality, a payment facility equivalent to a consumer credit loan that flouts legal obligations.
This judgment makes it impossible - without complying with rules concerning consumer credit - for the spread payment of the price of telephones as part of mobile packages. The recognition of the subsidy as a consumer credit could nullify certain contracts.
